Attorney Isabella S. Olczak’s presentation, “Business Formation, Contracts, and Trademarks in the World of Publishing,” provides a roadmap for authors looking to professionalize their creative careers. Olczak emphasizes that protecting your literary assets begins with choosing the right business structure, whether a Sole Proprietorship or an LLC, to manage taxes and liability. She further demystifies some of the contract complexities, highlighting critical clauses that may include the grant of rights, royalty structures, and “reversion of rights” which determine how long a publisher controls your work. Finally, she clarifies the nuances of trademark law, explaining how authors can protect series titles and brand names through federal registration to distinguish themselves in a crowded marketplace.
